They make a wide variety of Consumer Products. There are subsidiary companies also. And there are vary many brands. In this page, many are put together to the extent I can recollect. It is advisable that a reader knows them

 

Hindustan Lever is a Scoundrel - this point is proved in other pages like Toilet Soaps

 

The term 'Scoundrel' has been used after checking the meaning in Chamber’s Dictionary.

Hindustan Unilever often shamelessly, recklessly and with impunity present disturbing facts and distortions to the public. The collated facts and their dissections make me call them a Scoundrel. The Government and the Regulating Authorities know nothing. The Media feigns ignorance and acts blind if some advertisements are thrown at them. The Public suffers. Know this scoundrel so that you can spot another. There are many to pinch your purse besides Government

 

Law of the Land

Know the terms and spirit of the Law and then study the page. Wonder where the enforcers are ?

MRTPC, now renamed as Competition Commission, quoted the below mentioned Ruling of the Supreme Court of India, while passing the verdict in the first case between Colgate and Hindustan Unilever

The Supreme Court had ruled that  "the object is to bring honesty and truth in the relationship between the manufacturer and the consumer". And "if the general impression conveyed is false, the most punctilious and scrupulous accuracy in immaterial minutiae will not render the representations true"  [a lie is a lie even if covered with irrelevant packing and convoluted explanations]

2. MRTPC: "if the claim of "102"% anti- bacterial superiority is ultimately not found to be true," consumers by and large can be said to have been duped by such advertisement campaign - if the advertised claim is ultimately not found to be true can be substituted for the earlier words within quotes. That is, the observation is not meant for one case but for all tall, dubious and unproven claims

3 Affected Party / Public: 'This injury caused to the public in general can hardly be compensated in terms of money, as the feeling of being duped cannot be evaluated in monetary terms'. This observation is against Hindustan Lever.

Has the Public ever been compensated, in deeds, money or punishing the guilty in the last 50 years ?

Brand is just a name that is often referred for commercial products. Brands can make atrocious claims for boosting sales is a convenient assumption and not the Law. That they go unpunished is a different matter. Anna Hazare is just a name. It is also a powerful brand today.

You and I are also Brands - a distinct entity. Are we allowed to misrepresent ? Can I give a wrong address to the Bank or IT department. No. So, let us not fool ourselves that Corporates are different from individuals. The levity given to Scoundrels like Lever will only hurt the Public routinely like mosquitoes

 

My views

If I were the President, I will put the Chairman and the Board in jail, besides group heads and also make them pay 10 Crores penalty per day for every suspect product, till they provide the proof for a claim  / or prove the benefit that they claim for a product.  Secondly, they should release double the number of advertisements, admitting their misdeeds and clarifying the position / exact facts to the public.

 

Why single out Hindustan Lever ?

Lever Brothers is an over 150 years old, world wide company. Hindustan Unilever is the Indian Wing, with over 10000 Crores Sales. Personal Care Products perhaps account for the bulk. Their daily spend on Advertising is 10 Crores.

1. If a court punishes a major culprit in the field, other smaller ones will take note and automatically behave

2. I do expose the questionable claims and practices of Marico, Johnson & Johnson, Himalaya and others in other pages in this site.

3. At 69, I spend over 5 hours a day watching TV. Lever’s frequent advertisements naturally catch my attention

4. You have to take into account the other pages mentioned above, to get a consolidated picture.

However, on this page,  my views are confined to Lever to serve as a sample case to the reader

 

Lever's lofty standard before Court

 

Monday, 15th March, 2010: Business Standard    Reporting on the basis of briefing / news gathered

Lever filed a complaint against Ariel / Proctor & Gamble, accusing it of making 'unsubstantiated Claim'. Making an 'unsubstantiated Claim' is legally wrong is accepted by Hindustan Unilever.

How many of Lever's products are backed by 'substantiated claims' and how many are blared with 'unsubstantiated claims?'

Lever's charge:  " P&G, by naming its product as 'Naturals' is inducing false belief in the consumers that the detergent powder is softer on the skin and ...."  I agree with HUL's argument.

The above stand of HUL before the Madras High Court confirms their dubious double standards. So, if they are caught on the same ground for other products, it exposes them to be a cheap and deliberate dupers of Public

Amaze - baseless claim to dupe the public

 

Times of India, Ahmedabad dated 13th February, 2010:

Heading:  HUL Guilty of making misleading ad claims

'.. Hindustan Unilever has been held guilty by a high powered body under the health ministry of making false and misleading claims on its malted beverage 'Kissan Amaze'...

Their claim that the Kissan Amaze would have 'favourable action on Brain Power' is without any Medical Research or Proof.

Contrast: 1998: Lever argued against Colgate with MRTPC that ‘that there is no published evidence of efficacy of Xylitol in the absence of Fluoride’.

How can a personal care company broadcast a product, claiming to have an impact on Brain, without any Medical Research or Proof ? Where is the evidence ? Lever is guilty by its own 1998 stand. What is the Drug Department doing ?

 

All Clear Shampoo - unsubstantiated over claim

TV Advertisement claims 25-12-2007 and 1-1-2008

‘ Dandruff will not come back after a week, a month or a year‘  - market results / Lever's action does not support this claim

Does it not mean that the other anti dandruff shampoos of Levers, are not as good as All Clear ? Why sell less effective products ?

Market figures either in India or elsewhere does not support the next logical view - All Clear has become a world famous shampoo and sizeable section of the Indian Society got rid of Dandruff

 

Clinic Shampoo - overblown bluff / lie

The 1993 Label of Clinic Shampoo mentioned that it is based on " Latest Internationally Proven Formula".

Each of the word, Latest, Internationally as well as proven, is questionable. Where it got proved and how ?

Lever’s records and actions will prove that these are blatant lies. It was ineffective and non functional is proved by 2 market facts.

1. Lever’s own advertisement for All Clear, dilutes Clinic’s claim

2. The All powerful 1997 version of the product had 'The New Faster Acting Formula' against Dandruff. In 4 years, Lever has improved further upon its " Latest Internationally Proven Formula".

3. If these were effective, as an early entry shampoo by 1970, there should not have been any need for All Clear, Sunsilk, Dove or other shampoos at later dates

If Clinic was not good, why sell as ‘internationally proven formula’ ? Is it not misguidance of the public ?

 

Clinic Plus - Blatant cheap Lie

Advertisement Source and message

Star Plus Channel, about 2210 hours:, 30th January, 2002 and Star Plus Channel, Khulja Sim Sim programme, February 1, 2002

"92% of hair is protein. Soap weakens / lowers the protein. Result ? Hair becomes brittle and breaks. The Hair Suffers. New Clinic Plus restores the Protein to the hair."   Lever cannot defend this claim. It is absurd and unscientific

[ How I wish that the body hair is made out of Silver and not Keratin ? Silver price has nearly doubled in 18 months ]

Body hair is also made out of Protein / Keratin. Lever is more than 150 years old. Do their records show that their soaps harmed the hair, before introduction of Shampoo ? Should they not check their records before opening the mouth too wide

If yes, those who lost should seek proper legal counsel / compensation in their respective countries, now that they 'have the confessional statement' from Levers. We all use Soaps to clean ourselves and not loose the body hair.

If what they say is true, it is a self confession that they are cheats.

The proof is simple. All Indian Males take bath with Toilet Soaps / Toilet bars . They all should have lost the body hair with routine, daily use. They have not. So, what Lever says is a lie.

If you have been purposely misled by the other person for his benefit, it is a blatant breach of trust in a way.

In case they honestly mean what they said, they should stop selling their Toilet Soap / bars in India. How many males would like to loose the body hair ?

Hope an enterprising Attorney in US would find ways to file a civil suit

 

Lever’s dubious differing standards or standards, if any

 

1. Around 2003 one advertisement for Hamam soap said why go for a Soap and a shampoo, when Hamam Soap can do both the jobs, safely.

Hamam and Clinic Plus are both Lever’s product. The Claim of one contradicts another.. One is a deliberate lie

2. Protein can be absorbed / get into the outside, dead, head hair does not seem scientific. In the human body, protein is digested only in the intestine. If this novel delivery system is true, Lever should apply for Noble Prize

3. Shampoos are made out of detergents like SLS, which is not good for the skin as per findings today. Secondly, it is relatively stronger than Soap. So soap can overtake shampoo in damage does not make sense. To shift the blame to Soap is cheap distortion

4. Hair becomes brittle and break ? Is there any proof or medical finding ? It is a lie to scare the Public

Let them collect fallen hair from one house hold / one female and demonstrate the percentage of brittle or broken hair. If Lever cannot / if there is no instrument to assess that, they are talking unwanted nonsense

5. I think, Proctor and Gamble bought Gillette some years back. Its sales and profit keep rising. With Toilet Soap use on the face, should not the need for shaving reduce or stopped by now ? It has not

6. Bauer [ excuse me if the spelling is wrong ] sell the 'shavers' for Ladies. Their Sales as well as those of ‘ hair removers’ for ladies do not seem to be waning in Indian Market. Lever says ‘Hair suffers’ - need for reuse of remover after 3 or 4 weeks nearly nullifies all points / unscientific lies in Lever’s message

Whichever look at, Lever's message is riddled with contradictions and despicable lies. I do not expect such shameless lies even from a road side beggar or urchin.

 

Dove

 

Business World 19-5-93 to 1-6-93: page 57

"DOVE is being marketed as an Alkaline Substance Free Soap with one fourth Moisturiser for highly sensitive skin. Levers  even arranged a live pH test to demonstrate its Non alkaline nature. The test showed that Soaps like Camey, Godrej's Evita, Johnson & Johnson's and even Lever's own Pears had high alkaline content". 

Contradiction: Test used is same but, the interpretations need not be uniform to assess on that basis. Funny, is it not ?

Monday, 15th March, 2010: Business Standard

Dove was advertised as a High Quality Soap on TV. And it was getting imported from Dubai by Hindustan Lever. Perhaps around 1998, Custom Officials demanded duty as applicable for Toilet Soaps. They should have paid duty as Toilet Soaps - Business Ethics !

Ethics: Lever confessed to the Customs that it is a lower quality bathing bar only and paid duties accordingly. The confession must be in Mumbai Customs records

The confession makes me suspect the quality standards. And they are guilty of ‘inducing false belief’ with Dove - the very crime that that spoke against P & G in Madras High Court.

A Company / Brand that I would not rely upon to make a good quality soap, a low technology area, comes out ‘dove hairfall therapy’, an area where Medicine has not succeeded ? Is it logical and safe ? You have to decide

 

Fair & Lovely Anti Marks Cream - twisted facts

comparing its effectiveness and price with 'Nomarks' and Garnier Light 'anti marks + fairness concentrate'. 

Truth was the caption of the advertisement

One lie, makes the whole message suspect

'’Leading Dermatologists have certified that no cosmetic cream can ever make all your dark spots disappear or ensure they don't come back'  '‘Extensive in vivo [ in living organisms ] studies in India have proven that only with Fair & Lovely Anti-Marks do 100% of all users experience "reduction" in one or more type of marks'

'removal' was the caption over the graph !  Reduction and Removal are not synonyms. So, they are misleading the public

If dermatologists say that dark spots cannot disappear or removed and you accept that, fairness cream is a fraud in a way. It cannot reduce the 'large dark patch of the skin' - all fairness creams, including Lever’s, claim that in a way.

Fair & Lovely

 

Nothing Fair or Lovely except the name

is my short, summary view on this product. Lever should get ‘Duping India’ award. The fairness benefit is unsubstantiated and unproven in their own survey, conducted after 30 plus long years

1. Fairness is the advertised benefit of the product. In the sham survey that Lever conducted, Fairness was the unasked and untested feature. You sell a product for fairness. And it is not checked at all. The level of cheapness is nauseating

2. It is not a use alone product as advertised on TV

3. In the features tested, there is no significant difference amongst the four similar products of different companies. Yet the histograms is skewed and slanted in favour of Fair & Lovely. It is a deliberate misrepresentation

4. Whether the survey was done with 200 or 800 is not clear.

5. Survey was conducted in March 2008 and not started earlier and concluded in March 2008. How or why they did it within 31 days is a wonder.

6. Medical views are against Fairness Creams

It is a beautiful, appealing, decorative mannequin with no functional utility. In the end, it is just plaster of Paris.  

 

New Clear Shampoo

 

Hindustan Lever's advertisement: Headlines Today -  around 2230 hours on 25th August, 2011

 

'New Clear Shampoo is the best Shampoo in India'. If Lever has any integrity, they should stop 'Sunsilk'

unbeatable Shampoo is the new slogan for the New Clear Shampoo in the TV advertisement on or around 24th October, 2011. Whatever expertise they shouted about in the 40 years in Clinic Plus and such others was less than true is the only interpretation that I can make

I think that their first / one early advertisement was objected and withdrawn - perhaps Advertising Council of India finally acted

 

Pears Soap

 

Business World 19-5-93 to 1-6-93

" Levers  even arranged a live pH test to demonstrate its Non alkaline nature. The test showed that Soaps like Camey, Godrej's Evita, Johnson & Johnson's and even Lever's own Pears had high alkaline content"

They scare the Public with pH test / paper. And one of their own supposedly superior soap, fails the test. Tested in 2008:

The pH value of Rin and Vim is 8.5. Why sell RIN and VIM with pH of about 8.5 ?

Pepsodent - Duping ingrained ?

Ms Marino / Paras Pharmaceuticals - TV advertisements during December 2005 ODI Cricket Matches

Message:  It is immaterial what shampoo you use. It will make the hair dry and harsh. After Shampoo, use Ms Marino to keep your hair soft and healthy

If Paras knew it in 2005 and I knew it in 1995 [ criticised the use of shampoo in Tips for the Top booklet published in Oct 1995] Lever should have known it much earlier to 2005

Suppression of fact is a deliberate act of misdeed. The Society suffers. There must be laws to punish the offender

US Civil court levied a penalty of above 140 Billion Dollars on US Tobacco Companies for suppressing from the Public for years, the ill effects of Tobacco Smoking even after realising it

 

Sunlight

 

This was Lever's famous Washing [clothes] soap till 1970 / till detergents took over. On the inner side of the wrapper, there used to a guarantee by Lever. 'Rs 5000 reward to anyone who proves that this product contains any harmful chemical' or something similar. Both Lifebuoy and Sunlight used to sell for 25 paise in 1958.

[ I was a user of Lifebuoy from 1952 to 1969 and Sunlight till 1966 or so. There was no detergent then. The first cloth / white detergent, Det came around 1960. Lever came next with Rinso and then followed it up with Surf, in blue colour ]

Now even their Toilet bars are lower in quality / TFM compared to Sunlight. That is my feeling.

 

Sunsilk - Duping Heights ?

Lever’s advertised message

'Shampoos and boy friends are a bit similar in approach. They say one thing and do another. Can't fully bank upon !'

Hindustan Lever said that. Is it not a confession ? It is naive to take it as a failed humour. Public has been fooled for years, with fanciful and unproven benefits for its various shampoos.

Raju, founder of Satyam Computer was arrested on the basis of his own confessional statement about swindling. Outsiders / auditors did not know about it, to the extent he said, though there was unease after take over / merging of Maytas.

Why the Government cannot arrest Lever’s Chairman for duping the Public, if Keshub Mahindra, a non executive Chairman of Union Carbide could be arrested 25 years after Union Carbide’s fiasco ? Is not the Indian Law same for me and the President ?

Who the hell are they to comment about boy friends ? Women's empowerment society should also take up this matter.

2. Its brand ambassador for anti dandruff shampoo, Javed says that one should keep the hair short. Length and dandruff are not connected as per medical findings till date.

If the hair is to be kept short, it is not fit for Women. If it is not, the label should say that clearly [csp]

Again a case of suppression of relevant facts as per the ad

 

Sunsilk Conditioner - suppressed facts and duping

Sunsilk conditioner's advertisement came on Star one TV channel on 7th April and Sony TV channel, on 6-4-2009

Shampoo cannot reduce hair fall and will make the hair rough

They have suppressed this fact from the Public for years. Worse is the fact that they continue to do that. This is a deliberate and malicious act of misdeed in my view

If Cigarette makers put a warning signal on the label, Shampoo makers also should. We neither act fast nor take a broad view. Convenient patch work steps are often taken to appease some and ignore the 'mute millions'

 

Toilet Soaps - lowered quality / breach of trust

 

1. Basic / relevant fact: "Even today, Soaps exported to Russia must have at least 80% Total Fatty matter". "Girish Mehta, director [ Management Services] of Nirma Soaps feels that Synthetic detergents should not be used in Soap.

TFM lowered in the 3 bulk Selling Toilet Bars of India. If this is not breach of trust / backstabbing of customers, what is ?

Lever indulged in lowered quality that could / could have affected the skins of the Indian Public. Is it not an offense ?

3. I think Lever stopped, Reckit Coleman, makers of Dettol, from using Red Colour prominently in their Soap. The contention was that the Indian Public associate the Red Colour with Lifebuoy. That is, Lifebuoy is popular and many trust it is implied

That Lifebuoy was Cheapened by Lever at the cost of the Public - blatant breach of trust and taking the Public for a ride

 

Toilet Bars

Bathing Bars contain less TFM [ below 75%] and more of the skin harming materials. Naturally they should be deemed inferior in Quality. Dove is a bathing bar.

The Indian Toilet Soap Manufacturers Association / members not only set a new lowered standard but have perpetuated it after 1993 or so. Hindustan Lever holds over 40% share in toilet soaps / bar market.

Did the members form a cartel at the cost of Public in 1993 ? It seems like that. Godrej got out afterwards. ‘The company has taken a conscious decision to manufacture & market only high TFM (total fatty matter) Godrej's website News -16-9-1999:

[ I do not agree that Truth and Integrity have no place in Business or Government Offices.  Only about 95% of the fellows indulge in Corruption unlike in 1960, when it was perhaps 10%. These are my guesstimates. Anyway, we have lease for 20% of Greenland. If that 95% is settled in Greenland, problem gets resolved. Godrej No 1 Soap is getting increasing share of the market, with hardly much advertisement. It turned back on 1999 and started making high TFM soaps. ]

Lever's Message: For Long lasting Fairness, use Vaseline Face Wash

Vaseline is nothing but Petroleum Jelly. Lever's brand name for the jelly / was is Vaseline.

Petroleum Jelly - Petrolatum / mineral jelly

Natural Source: ‘By fractional distillation of still residues from the steam distillation of paraffin-base petroleum or from steam reduced crude oils from which the light fractions have been removed

Artificial / synthetic: By mixing heavy petroleum lubricating oil with a low melting point paraffin wax. The USP grade is called White Petroleum Jelly and NF grade is yellow petrolatum [ Condensed Chemical Dictionary, ]

If Petroleum Jelly can give long lasting fairness, why Fair & Lovely ? If Petroleum Jelly is ok, white Jelly would be available at below Rs 150 / kg. One can colour it with 2% of Titanium Dioxide, if Lever uses 5% Titanium Dioxide in Fair & Lovely !

Let us hope that Obama starts using Fair & Lovely to better his chances for reelection.

 

Water Purifier - Over claim

Lever's water purifier was promoted with a challenge of One Crore Rupees. It was not a proven product without equal as claimed.

Another company challenged the claim. Now the products of both the companies have to be verified / tested on various parameters by an independant Agency in America - 2010 news

As of January 2011, Lever’s advertisement has changed and it talks about removing a crore of microbes.

The One Crore Rupees is a Promise made on TV. I hope that some would be able to claim it, when the test results are out. Do preserve the purchase receipt - it can turn out to be a lottery
